JURISDICTIONAL STATEMENT

A. Basis For District Court’s Subject-Matter Jurisdiction
In Case No. 08-CV-5990 (“Case No. 5990”), Plaintiff-Appellant Roughneck Concrete Drilling & Sawing Co. (“Roughneck”) timely sought to vacate a labor arbitration award issued by the Joint Arbitration Board (“JAB”) pursuant to Section 301(a) of the Labor Management Relations Act of 1947, 29 U.S.C. §185(a) (“LMRA”). In Case No. 08-CV-7047 (“Case No. 7047”), Roughneck timely sought to enforce a labor arbitration award issued by the Plan for the Settlement of Jurisdictional Disputes in the Construction Industry (“National Plan”) pursuant to Section 301(a) of the LMRA, 29 U.S.C. §185(a), and the Federal Arbitration Act, 9 U.S.C. §10 (“FAA”).
