QUESTIONS PRESENTED

1. Whether the Equal Education Opportunity Act of 1974, 20 U.S.C. § 1703(f), provides a damages remedy where a public school has, based on national origin, failed to take appropriate action to overcome language barriers for English language learners.
2. Whether, under the Equal Education Opportunity Act, 20 U.S.C. § 1703(f), and Title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000d, direct evidence of discriminatory intent is required to sustain an action against operators of a federally funded school engaged in facially discriminatory practices against Petitioners based on their national origin.
