The City’s Opposition does not dispute the circuits’ conflicting treatment of both questions presented. The City simply contends that the Fifth Circuit’s approach is correct. That suggests that this Court’s review is warranted on these recurring issues. Moreover, the City’s defense of the Fifth Circuit’s approach reveals that circuit to be straying from the proper principles of municipal liability under § 1983. Certiorari should be granted.
